Decision made regarding Neart na Gaoithe CfD termination dispute

An arbitral tribunal has made its decision regarding the Low Carbon Contracts Company's decision to terminate the Contract for Difference (CfD) with Mainstream Renewable Power (MRP) regarding its Neart na Gaoithe offshore wind farm.

The tribunal ruled in favour of MRP after its subsidiary and project developer Neart na Gaoithe Offshore Wind Limited (NnG) initiated the dispute as per the dispute resolution processes set out in the CfD. The details of the dispute are, and will remain, confidential as both parties are bound by the confidentiality obligations both within the CFD and the rules of the arbitration.

The Neart Na Gaoithe's CfD of £114.39/MWh was cancelled by the Low Carbon Contracts Company (LCCC) on March 29th 2016. NnG had a deadline on the 26th March 2016 to reach financial close otherwise their CfD was in jeopardy of being removed.

NnG is in an ongoing legal dispute and judicial review with the Royal Society for the Protection of Birds (RSPB) who believe the impact of NnG's project, along with three others in the Firths of Forth and Tay "pose too great a risk" to the resident and migratory birds. The RSPB "over a thousand gannets and hundreds of kittiwake, could be killed each year during the summer months alone and many hundreds of puffin could die as a result of losing important feeding areas. "

RSPB submitted the legal challenge in January 2015 regarding the decisions by Scottish Ministers to grant consent for Inch Cape, Neart na Gaoithe, and Seagreen Alpha and Bravo offshore wind farms.

Located in the Outer Forth Estuary in the North Sea, the Neart na Gaoithe offshore wind farm could consist of up to 64 Siemens turbines, each with a 7MW rated capacity, situated on three-legged jackets. If constructed, the array will cover an area of 105km2 area and is expected to meet the energy demands of 325,000 Scottish homes annually. MPR was awarded the site in February 2009 by the Crown Estate as part of a competitive bidding process.
