Tenaga Nasional Berhad files legal claim over damaged interconnector

Malaysian utility company Tenaga Nasional Berhad has issued a legal claim against Iskandar Waterfront City Berhad (IWCITY) and its subsidiary Tebrau Bay Constructions Sdn Bhd (TBCSB) due to damage sustained by its 230KV
subsea interconnector which connects to Singapore.

On 17 November 2020, IWCITY was served with a Writ and Statement of Claim from Tenaga Nasional Berhad for the sum of RM 76,564,759.77 (approximately £14 million or $18.5 million).

Tenaga Nasional Berhad allege that agents of IWCITY and TBCSB trespassed on right-of-way and/or easement of the subsea cable on multiple occasions and caused damage of the cable on 5 November 2014. The claim also includes general damages, economic loss damages, and inconvenience damages.

Pre-judgment interest at the rate of 8% per annum from the date of the Plaintiff’s cause of action in respect of the damage to the said cables on 5 November 2014 until the date of judgment in accordance to the Civil Law Act 1956. Interest at the rate of 5% per annum calculated from the date of this Suit until the date of full settlement.

IWCITY is currently seeking professional legal advice and will appoint counsels to defend the claim. The Case Management date has been fixed by the Court on 9 December 2020 by way of e-Review.
If the claim is allowed, the financial impact will be the damages claimed and any additional cost or interest granted.

The
200 MW subsea interconnector transmits energy between Malaysia and Singapore Island. It was commissioned in 1985. The cable covers 16km with of which 4km is subsea. The cable connects between two substations, one in Plenko (Maylasia) and Senoko (Singapore). It is wholly-owned by Tenaga Nasional Berhad.
