25 Jun 2024: The Energy Board of Appeal has processed three more complaints related to the rejection of an application for a feasibility study license, taking the total number of overturned rejections to 23. The three projects that have been returned to the Danish Energy Agency for review are Paludan Flak, Vikinge Banke, and Kadet Banke. The sites were originally rejected due to a potential distortion of competition arising from state aid regulations, judged against Thor, which allegedly set new market conditions due to negative bidding. The Board have stated that 'the contested decision suffers from a specific, significant legal deficiency in the form of a lack of justification', as it finds that the reasons given for the rejection were insufficient, and no clarification is given as to why Thor dictates new market conditions. Furthermore, the Board finds that the risk profile is different, and state aid is given to Thor in the form of a grid connection, which is not given to the open door projects, and is therefore not immediately a comparable project. The DEA have responded stating 'The Danish Energy Agency will now closely study the decisions of the Complaints Board and, in dialogue with our legal advisers, assess how the Board's decisions give rise to an adjustment of the decisions, or whether the case may need to be brought before the courts in order not to risk awarding illegal state aid.'
