26 Mar 2021: Havsul 1 AS applied on 25 June for an extended commissioning deadline until 1 January 2025. This was approved by NVE on the 27th March 2020. The original deadline defined in the construction licence (dated June 2008), prior to previous extensions, was June 2013. In undertaking a review of the latest extension, following an appeal, the Ministry of Petroleum and Energy has concluded there is no legal claim to receive an extension and that it must depend on the general discretion of the administration and licensing authorities. There is a general concern that unrealized wind projects restrict land use and stand in the path of societal development, and that, as many years have passed, the circumstances can change which necessitate new or updated studies. In Havsul's case the region's power production capacity has increased, there is no guarantee that a further extension will lead to the project realisation, the original licence and impact assessment are old and the project's economics are unclear. The Ministry has decided any new plans development of the Havsul 1 wind farm should possibly be considered through a new licensing process. According to the Marine Energy Act §1 second paragraph, this requires a prior process of opening the area. Therefore the Ministry has rejected the application for extension and upheld the appeals against the extension. The deadline for realising the plant remains as 1 January 2020. The Ministry's decision in the appeal case cannot be appealed.
